The New York State Energy Research and Development Authority (NYSERDA)
requests proposals from Heating, Ventilating and Air Conditioning
(HVAC) contractors interested in designing and installing an HVAC
system at 10 Hermes Road, Malta, New York, located in the Saratoga
Technology + Energy Park. 10 Hermes Road is a +/- 23,000- square-foot
facility, currently used by its tenants for offices and light industrial
work. The minimum heating efficiency requirement is 85%, and the air
conditioning minimum SEER is 12. The system must conform with New
York State Executive Order No. 111.
All firms interested in submitting a proposal shall be required to
inspect the building. Inspections will be given on Thursday, May 22,
Tuesday, May 27, and Thursday, May 29, beginning at 8:00. Additional
times are 9:30, 11:00, 1:00, 2:30, and 4:00 both days. To reserve

ext. 3259. Only those firms that reserve a time will be provided an
inspection, and be considered for project award. It is required that
the individual responsible for managing the project be present. Additional
dates will be made available if necessary. Building and existing HVAC
blueprints will be available for inspection during the allotted time.

Faxed or e-mailed proposals will not be accepted. Proposals will not
be accepted at any other NYSERDA location other than the address above.
I. BACKGROUND INFORMATION
In August 2001, Governor Pataki announced the creation of the Saratoga
Technology + Energy Park (STEP), a 280-acre parcel located
in the Town of Malta and owned by the New York State Energy Research
and Development Authority (NYSERDA). NYSERDA is working in conjunction
with the University at Albany, the Saratoga Economic Development Corporation,
and the Town of Malta to develop STEP into a clean energies technology
park.
Currently located at STEP is an existing +/- 23,000-square-foot (sf)
building at 10 Hermes Road that was constructed circa 1970, and houses
three tenants - the Building Performance Institute, Starfire Systems,
Inc., and Global Resource Options. The Building Performance Institute
occupies +/- 1,500 sf of office space and +/- 170 sf of assembly space,
Global Resource Options leases +/- 100 sf of office space, and Starfire
Systems occupies +/- 3,939 sf of offices, and +/- 17,294 sf of laboratory
and manufacturing space. The assembly and manufacturing areas have
high ceilings.
The heating, ventilation and air conditioning (HVAC) system is outdated
and inefficient, and needs to be replaced to improve the efficiency
of the building and to lower the tenant's utility bills. NYSERDA is
looking to employ the same environmentally sound and energy-efficient
principles at 10 Hermes Road that it promotes to its constituents.
Therefore, the new HVAC system is to be as energy efficient as is
cost effective, given the age, use, and condition of the building.
II. SCOPE OF SERVICES
Interested parties are asked to submit a proposal for the design and
installation of an HVAC system at STEP. The contractor shall be responsible
for assessing the needs of the building and its tenants. Services
shall be provided in accordance with the highest standards of professionalism,
skill, workmanship, and applicable trade practices and shall conform
to all applicable codes and regulations. The system that is designed
and installed must conform with NYS Executive Order No. 111, which
can be found on our website.
The heating system is to have a minimum efficiency of 85%, and the
air conditioning system a minimum SEER of 12.
The HVAC system must be integrated with Starfire System's air exhaust
system, consisting of two blowers, and a Trane heating system used
for drying paint. The paint booth heater uses 3,600 cfm of air, and
can obtain air from inside or outside the building. The system uses
50 kW, and has six stages, with the temperature increasing 7
degrees per stage.
The HVAC system must consist of zones for the various sections of
the building. The system must have proper controls. Existing pipes
and duct work should be used to the greatest extent possible. New
heat pumps may be required, and the cooling tower may need to be replaced.

1, 2003.
III. MINIMUM QUALIFICATIONS
All firms that submit a proposal shall be required to meet the following
minimum qualifications:
- The firm must have a minimum of five (5) years experience in
the commercial HVAC market for design, installation and controls;
- The firm must be on file with the NYS Department of State for
conducting business in New York; and
- The firm must be capable of obtaining a performance bond in the
amount sufficient to cover the cost of the project.
IV. PROPOSAL REQUIREMENTS
Six copies of your proposals are required. The completed Proposal
Checklist must be attached to the front of each copy. NYSERDA reserves
the right to eliminate from further consideration any proposals deemed
to be incomplete, or substantially or materially non-responsive to
this RFP. Submissions must include answers to all questions below.
Proposals are to be on 8-1/2" x 11" sheets, with your firm's
name on each page. Each answer should be numbered and titled, and
answered in the order presented below. Proposals must not exceed 7
pages in length, excluding specifications sheets.

B. Experience
Describe your firm's experience in providing the type of commercial
HVAC design, installation, and control services that are being sought
through this solicitation. Provide a list of three (3) references,
including name, address, phone number, e-mail address, and a brief
description of services provided.
C. Schedule
Clearly define when work would be scheduled to begin, the length of
time to complete the installation, and the proposed completion date.
Also, indicate if there are any impediments to having the HVAC system
designed and installed prior to October 1, 2003.
D. Specification Sheets
Provide specification sheets for each system and control to be installed.
E. Project Staff
Provide the name of the individual who will act as the Project Manager
for this project, and his or her experience and qualifications.
A. The firm must be free from any financial interest in a product
or service which may conflict with, or appear to conflict with,
the objectivity of providing the design and installation services
required of this RFP, for either NYSERDA or current tenants.
B. Fully disclose any current or pending business relationships
with NYSERDA, Starfire Systems, Inc., Building Performance Institute,
and/or Global Resource Options.
V. COST
On your own form, prepare an estimate for the work to be completed.
The estimate must be detailed, breaking out the cost of various components
and controls, and labor, including hourly rate for each staff position.
The cost must also include the removal and proper disposal of existing
systems, which is to be broken out separately.
VI. LIFE CYCLE COST ANALYSIS
On your own form, prepare a life cycle cost analysis for the system
to be installed.
VII. PROPOSAL EVALUATION AND CONTRACTOR SELECTION
Proposals from firms that did not conduct an inspection of the building
will be disqualified.
Proposals submitted in response to this Request for Proposals will
be reviewed and scores assigned based solely on the information submitted.
Proposals will be evaluated based on the following criteria, presented
within each category in descending order of importance:
1. Experience and Qualification (65%)(see Section II, III,
and IV A and B)
- The experience and qualifications of the staff committed to the
project. (60%)
- The ability to have the HVAC system installed and operating no
later than October 1, 2003. (5%)
2. Cost and Life Cycle Cost Analysis (35%) (see Section V
and VI)
- Total cost for the project. (15%)
- Life cycle cost analysis results. (15%)
- Does the efficiency of the HVAC system meet the requirements,
and meet or exceed NYS Executive Order No. 111 requirements. (5%)
VIII. GENERAL CONDITIONS
Proprietary Information - Careful consideration should be
given before confidential information is submitted to NYSERDA as part
of your proposal. Review should include whether it is critical for
evaluating a proposal, and whether general, non-confidential information,
may be adequate for review purposes.
The NYS Freedom of Information Law, Public Officers law, Article
6, provides for public access to information NYSERDA possesses. Public
Officers Law, Section 87(d)(2) provides for exceptions to disclosure
for records or portions thereof that "are trade secrets or are
submitted to an agency by a commercial enterprise or derived from
information obtained from a commercial enterprise and which if disclosed
would cause substantial injury to the competitive position
of the subject enterprise." Information submitted to NYSERDA
that the proposer wishes to have treated as proprietary, and confidential
trade secret information, should be identified and labeled "Confidential"
or "Proprietary" on each page at the time of disclosure.
This information should include a written request to except it from
disclosure, including a written statement of the reasons why the information
should be excepted. See Public Officers Law, Section 89(5) and the
procedures set forth in 21 NYCRR Part 501.

Contract Award - NYSERDA anticipates making one award under
this solicitation. It may award a contract based on initial applications
without discussion, or following limited discussion or negotiations.
Each offer should be submitted using the most favorable cost and technical
terms. NYSERDA may request additional data or material to support
applications. NYSERDA will use the Sample Agreement to contract successful
proposals.
Limitation - This solicitation does not commit NYSERDA to
award a contract, pay any costs incurred in preparing a proposal,
or to procure or contract for services or supplies. NYSERDA reserves
the right to accept or reject any or all proposals received, to negotiate
with all qualified sources, or to cancel in part or in its entirety
the solicitation when it is in NYSERDA's best interest.
Disclosure Requirement - The proposer shall disclose any indictment
for any alleged felony, or any conviction for a felony within the
past five years, under the laws of the United States or any state
or territory of the United States, and shall describe circumstances
for each. When a proposer is an association, partnership, corporation,
or other organization, this disclosure requirement includes the organization
and its officers, partners, and directors or members of any similarly
governing body. If an indictment or conviction should come to the
attention of NYSERDA after the award of a contract, NYSERDA may exercise
its stop-work right pending further investigation, or terminate the
agreement; the contractor may be subject to penalties for violation
of any law which may apply in the particular circumstances. Proposers
must also disclose if they have ever been debarred or suspended by
any agency of the U.S. Government or the New York State Department
of Labor.
