ADVANCED MONITORING PROGRAM
Program Opportunity Notice (PON) No. 619-01

PON 619-01 Advanced Monitoring Program is currently oversubscribed
for funds. A waiting list has been developed. All new applications
will be placed on the waiting list in the order in which they
are received in the event additional funds are made available

The New York State Energy Research and Development Authority (NYSERDA),
as administrator of the New York Energy $martSM
program, requests applications from eligible building owners and leaseholders
for financial incentives to use advanced monitoring technology for
price responsive load management and energy performance contracting.
$1.5 million is available through this PON to offset out-of-pocket
expenses associated with installing advanced building metering equipment
for energy consumption data acquisition. NYSERDA will provide financial
incentives for web-enabled advanced monitoring. The awards for web-enabled
advanced monitoring (WEAM) shall reimburse the applicant 70% of the
out-of-pocket expenses related to the development of a WEAM system
for institutional applicants and 50% of the out-of-pocket expenses
for commercial and industrial applicants. These eligible out-of-pocket
expenses shall not exceed $1.00 per square foot of building area or
$25,000, whichever is less.
Eligible applicants are those who are electricity distribution customers
of: Central Hudson Gas and Electric Corporation, Consolidated Edison
Company of New York, Inc., New York State Electric & Gas Corporation,
Niagara Mohawk Power Corporation, Orange and Rockland Utilities, Inc.
and Rochester Gas and Electric Corporation and who pay into the System
Benefits Charge (SBC).

I. INTRODUCTION
OBJECTIVE
NYSERDA announces a program to provide incentives to assist institutional,
commercial and industrial customers in using advanced monitoring technology
via the internet. Advanced monitoring (or advanced metering) provides
owners and leaseholders with the opportunity to save energy by identifying
energy uses and opportunities for improvements. The primary means
to reach the energy savings goal of this program is to encourage applicants
to use price responsive management in their use of energy or to pursue
a comprehensive energy performance contract.
Effective advanced monitoring systems identify a broad range of energy-efficiency
improvement measures. These systems have the potential to reduce energy
consumption from all fuel types through the installation of a mix
of long and short payback energy efficient measures. While the incentives
awarded under this program will favor projects which have high electric
savings potential, NYSERDA encourages applicants to take a comprehensive
approach of assessing all types of energy use to determine potential
energy savings.
Awards provided under this program offer financial incentives to
help applicants defray expenses incurred in developing a price responsive
load management system and/or a comprehensive energy performance contract.
Program applicants will need to fill out the application form included
in this PON (page five to page seven). Applicants are encouraged to
seek assistance from Energy Services Companies (ESCOs) in order to
maximize the benefit of the potential incentive awarded.
AVAILABLE FUNDS
NYSERDA has available up to $1,500,000 in this PON. Applications
will be reviewed as soon as NYSERDA receives them within the time
frame of the program until the available funds are fully committed.
II. PROGRAM REQUIREMENTS
ELIGIBLE PROPOSERS
Eligible participants are institutional, commercial and industrial
building owners and leasees who are New York State electricity distribution
system customers of Central Hudson Gas & Electric Corporation,
Consolidated Edison Company of New York, Inc., New York State Electric
& Gas Corporation, Niagara Mohawk Power Corporation, Orange and
Rockland Utilities, Inc. and Rochester Gas and Electric Corporation,
who have utility data for at least six months and who pay into the
System Benefits Charge fund. Applicants who received a NYSERDA incentive
prior to December 24, 2001 for web-enabled advanced monitoring through
the Institutional Energy Performance Contracting Assistance Program
(PON 565-00), interval meters through the Peak Load Reduction Program
(PON 577-00), metering through the Technical Assistance Program (PON
583-00) and (PON 605-01), and the Industrial and Building Controls
and Sensors Program (PON 598-01) for specific facilities are not eligible
to receive metering incentives under this program for the same facilities.
INCENTIVES AND MATCHING CONTRIBUTIONS
Applicants meeting the minimum requirements are eligible for an
award. First-come, first-served incentive awards will cover 70 percent
of the out-of-pocket expenses for web-enabled advanced monitoring
(WEAM) for institutional applicants and 50 percent of the out-of-pocket
expenses for commercial and industrial applicants. These eligible
out-of-pocket expenses shall not exceed $1.00 per square foot of
building area or $25,000, whichever is less. In-house expenses for
salaries, etc. and capital costs of implementing energy-efficiency
measures are not eligible. If the applicant is approved for an award
they must submit a Task Work Order acceptable to NYSERDA to obtain
a purchase order. Awards will be payable in two installments. After
satisfactory completion of a live internet test of the monitoring
system, 75% of the financial incentive will be paid for the initial
reimbursement. After one year of data has been collected, the remaining
25% of the financial incentive will be paid for the final reimbursement.
A single building application can be submitted for a complex of
buildings i.e. college/university campus, hospital, etc. provided
the applicant is responsible for paying the utility bills for the
buildings to be monitored.
Applicants may contract with a third party to develop, install
and monitor the WEAM. A sample form contract is provided to assist
applicants in negotiating terms with a contractor for web-related
efforts (Appendix E).
REQUIREMENTS
- The WEAM system must be installed within one year of the award
notice and NYSERDA must have access to the data for at least two
years.
- Requests for final payment along with the required deliverables
must be received by NYSERDA within fourteen (14) months from the
date of the approval of the live internet test.
- Expenses for WEAM must be incurred between December 24, 2001
and fourteen (14) months from the date of the approval of the live
internet test.
- An applicant is defined by their Federal Identification number.
III. APPLICATION REQUIREMENTS
Applicants must fill out the application form, Appendix A (Application
Checklist), and Appendix B (Web-enabled advanced monitoring) in its
entirely, leaving no blanks. The completed Application Checklist must
be attached to the front of each copy of the Application. Application
forms and the Application Checklist must contain an original signature.
Where a specific item does not pertain to the item in question, please
provide a brief explanation. For facilities with more than one building,
aggregate all data for applicable buildings under consideration for
a WEAM system into a single application form.
IV. AWARDS AND DELIVERABLES
Applications pertain to WEAM for the institutional, commercial and
industrial markets. Awards will be provided to qualified applicants
on a first-come, first-served basis for WEAM until funds are fully
committed. Upon receipt of an application, NYSERDA will review it
and determine whether the applicant qualifies for an incentive. If
the applicant qualifies, NYSERDA will notify the applicant that they
are eligible for an incentive and request that a Task Work Order for
the WEAM be submitted. A sample Task Work Order is attached as Appendix
C. After approval of the Task Work Order, NYSERDA will issue a Purchase
Order and direct the applicant to install the web-enabled advanced
monitoring system. A sample Purchase Order is included in Appendix
D. The requirements of the WEAM system will be attached to the Purchase
Order as Exhibit A.
In order to receive payment for the WEAM, the applicant will be required
to deliver to NYSERDA a live test of the service, invoices for all
eligible out-of-pocket expenses, and a letter requesting payment.
Upon receipt and approval by NYSERDA of the WEAM deliverables and
invoices, a check will be issued to the applicant representing 75%
of either the award or the total cost of the WEAM system, whichever
is less. The remaining 25% will be issued after, and be conditional
upon, one year of operation. The final amount of the award will be
based on the total eligible out-of-pocket expenses submitted to NYSERDA,
but in no case shall the amount exceed the amount of the Purchase
Order.
VI. GENERAL CONDITIONS
PROPRIETARY INFORMATION - Careful consideration should be
given before confidential information is submitted to NYSERDA as part
of your application. The applicant should determine whether the information
is critical for evaluating an application or whether general, non-confidential
information, may be adequate for review purposes. The New York State
Freedom of Information Law, Public Officers law, Article 6, provides
for public access to information NYSERDA possesses. Public Officers
Law, Section 87(d) (2) provides for exceptions to disclosure for records
or portions thereof that "are trade secrets or are submitted
to an agency by a commercial enterprise or derived from information
obtained from a commercial enterprise and which if disclosed would
cause substantial injury to the competitive position of the
subject enterprise." Information submitted to NYSERDA that the
applicant wishes to have treated as proprietary, and confidential
trade secret information should be identified and labeled "Confidential"
or "Proprietary" on each page at the time of disclosure.
This information should include a written request to except it from
disclosure, including a written statement of the reasons why the information
should be excepted. See Public Officers Law, Section 89(5) and the
procedures set forth in 21 NYCRR Part 501.

INCENTIVE AWARD - NYSERDA may make an award based on an initial
application without discussion, or following limited discussion or
negotiations. NYSERDA may request additional data, or material to
support the application.
LIMITATION - This solicitation does not commit NYSERDA to
award a contract, pay any costs incurred in preparing a proposal,
or to procure or contract for services or supplies. NYSERDA reserves
the right to accept or reject any or all Applications received, to
negotiate with all qualified sources, or to cancel in part or in its
entirety the solicitation when it is in NYSERDA's best interest.
DISCLOSURE REQUIREMENT - The proposer shall disclose any indictment
for an alleged felony, or any conviction for a felony within the past
five years, under the laws of the United States or any state or territory
of the United States, and shall describe circumstances for each. When
a proposer is an association, partnership, corporation, or other organization,
this disclosure requirement includes the organization and its officers,
partners, and directors or members of any similarly governing body.
If an indictment or conviction should come to the attention of NYSERDA
after the award of a contract, NYSERDA may exercise its stop-work
right pending further investigation, or terminate the agreement; the
contractor may be subject to penalties for violation of any law which
may apply in the particular circumstances.
